Emalahleni Local Municipality (ELM) is a Water Services Provider within the area of its jurisdiction. According to Water Services Act (WSA), water provision shall be provided such that it meets the demand, support economic activities, sustainable development, poverty eradication and environmental protection. Sustainable and adequate water security is one of the key supports of the local economy and to this extent where there is no capacity, the municipality through prescribed legislative imperatives and policies concluded agreements/contracts with external service providers to augment municipal water supply.
The water supply augmentation is done through reliable, sustainable, environmental friendly and cost effective methods such as mine water reclamation and modular package plants. The concluded agreements has expected life expectancy which when lapsing the municipality should be in position to maintain sustainable provision of services as prescribed. The envisaged extensions will be up to a maximum of five years (5) as per legal prescriptions and supporting operational requirements. It is against the above background that the municipality solicits inputs and presentations from local community in line with the provisions of MFMA Section 116.

The following are proposed amendments for the contracts/agreements as concluded:
- Mine water reclamation scheme (Anglo Operations Proprietary Limited) as it is due for renewal and extension for a period to be 5 years in line with the MFMA provisions. This is due to the fact that the scheme has been in operation since 2007 and it is part of the long term water supply scheme for the municipality in support of residential and economic growth.
- Modular package plant (NuWater) located and operating at Point B reservoir. The contract is envisaged to be extended by additional 6 months as the current contract is due to expire. The extension will than cause the contract to go beyond 3 years as suggested under MFMA. The purpose of extension was to allow smooth transition on the change of service providers without interfering with sustainable water supply.
The communities are expected to submit their presentations or comments on the proposed amendments at the Records Office, 2nd Floor, Emalahleni Local Municipality Building, Corner Arras & Mandela Street, Emalahleni, between 10am and 4pm, Monday to Friday, on or before Friday, 20 May 2022
